Blundstone ‘Win a Brute of a BBQ’
Terms and Conditions
By entering the Blundstone ‘Win a Brute of a BBQ’ competition, you are agreeing to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents aged 18+ of New Zealand via entry through participating stores.
2.2 Employees and their immediate families of Blundstone New Zealand, John Bull footwear, and their associated agencies and companies are not eligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. HOW TO ENTER
3.1 The competition commences on Wednesday 1 October 2008 at 9.00am NZ and concludes on Sunday 30 November 2008 at 5.00pm NZ ("the Competition Period").
3.2 In order to enter, customers must purchase a pair the Blundstone Brutes range from participating stores, customers must then affix their receipt as proof of purchase to the completed entry from and place the receipt and entry from in to the entry box located in participating stores.
3.3 Entries must be received by Sunday 30 November 2008 at 5.00pm NZ.
3.4 The entry must:
(a) be completed on the original entry form available in store.
(b) have the original receipt as proof of purchase affixed to completed entry form.
3.5 Entry details remain the property of the Promoter and will not be returned to the entrant. The winners agree to grant the Promoter a perpetual and non-exclusive licence to use their entries in all media nation-wide and the winners will not be entitled to any fee for such use.
4. PRIZES
4.1 There will be a total of one (1) winner of the competition. The winners will receive the following prize package:
- BBQ – Professional 8
Total Prize Value $3,599 NZD
4.2 Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is accepted.
4.3 The winners are responsible for all other expenses.
4.4 The prize is not transferable and cannot be redeemed for cash or other goods or services.
4.5 The winner will be notified by phone and also in writing via the contact details supplied on their entry.
4.6 In participating in the promotion, the winners agree to participate and co-operate with the Promoter and the Sponsor as required in all editorial and promotional activities relating to the Competition, including but not limited to being interviewed and photographed. The winners agree to grant to the Promoter a perpetual and exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.7 The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
5. HOW TO WIN
5.1 The winner will be those entries selected at random from a barrel draw by representatives appointed by the Promoter. All entries will be drawn at 10.00am NZ STANDARD TIME on 15 December 2008 at Blundstone New Zealand 218 Swanson Rd, Auckland. The competition is a game of chance and the Promoter plays no part in determining the winner.
5.2 Winners will be notified by a phone call within 3 days of determination of the winner, Winners will also be posted on the Blundstone website (www.blundstone.com).
5.3 The judges' decision is final and the Promoter will not enter into correspondence regarding the result.
5.4 Incomprehensible and illegible entries will be deemed invalid.
5.5 It is a condition of accepting the prize that the winners must comply with all the conditions of use of the prize and prize supplier's requirements.
5.6 It is a condition of accepting the prize that the winners may be required to sign a legal release in a form determined by the Promoter, as the case may be, in their absolute discretion.
5.7 If the winner does not collect their prize within a three (3) month period the promoter reserves the right to re-draw the prize. The re-draw will take place on 30 March 2009, at Blundstone New Zealand 218 Swanson Rd, Auckland at 10AM.
6. NO LIABILITY
6.1 In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter's ability to proceed with the competition on the dates and in the manner described in these terms and conditions.
6.2 Blundstone New Zealand Ltd, any associated retail store and or their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3 Blundstone New Zealand Ltd, any associated retail store and or their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur.
6.4 Blundstone New Zealand Ltd, any associated retail store and or their associated agencies and companies reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose.
6.5 Blundstone New Zealand Ltd, any associated retail store and or their associated agencies and companies reserves the right in its sole discretion to disqualify any individual who the Promoter has reason to believe has breached any of these conditions, or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
6.6 Blundstone New Zealand Ltd, any associated retail store and or their associated agencies and companies assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries, and reserves the right to take any action that may be available.
6.7 If for any reason this competition is not capable of running as planned, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the competition subject to written instructions from State Regulatory bodies.
7. PROMOTER'S DETAILS
7.1 The Promoter is Blundstone New Zealand 218 Swanson Rd, Auckland, New Zealand
7.2 All entries and any copyright subsisting in the entries become and remain the property of the Promoter. The Promoter collects personal information about entrants to include entrants in the promotion and where appropriate award prizes. If the personal information requested is not provided, the entrant may not participate in the promotion. By participating in the promotion, each entrant also acknowledges that a further primary purpose of collection of entrants’ personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact entrants in the future with information on special offers or provide entrants with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian related companies and promotional partners and may contact entrants with special offers in this way. By entering the promotion, each entrant agrees that the Promoter may use entrants’ personal information in this manner. Each entrant also agrees that the Promoter may publish or cause to be published the winner’s name and locality in any media as required under the relevant lottery legislation. Entrants can also gain access to, update or correct any personal information by contacting the Promoter at the address below. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
